    On Wednesday the 21st of October, the NSW Minister for Roads and Ports, the Honourable Duncan Gay, whilst launching the Motorcycle Council of NSW’s Motorcycle Awareness Week at Circular Quay in Sydney, announced that NSW will allow the use of European Certified motorcycle helmets, compliant with UN ECE22.05. This will take effect as soon as the ACCC change Consumer Protection Notice Number 9.
    Whilst Qld, Vic and the Northern Territory allow riders to use ECE22.05 helmets, they are unable to legally purchase them in Australia until the ACCC acts to amend its legislation.

    The announcement from the NSW Roads and Ports Minister adds further pressure to the ACCC to change the regulations for purchase and distribution in line with the MCC of NSW and the Australian Motorcycle Councils stated objectives. The announcement also reinforces the information that came out of the recent helmet standards forum hosted by Standards Australia in Sydney.”

    Even though Qld, Vic and NT have introduced ECE22.05 in their respective states they actually based the regulations on the NSW information that came out of the discussions from the Centre for Road Safeties Helmet Working Group, a sub set of the Motorcycle Safety Implementation group.

    The Ministers announcement also puts in place some security for local retailers and ensures that NSW riders will be able to try on helmets for correct fit which is one of the basic requirements for helmet safety.

    · Tasmania, South Australia and NSW have all announced they will allow use of ECE 22-05 helmets as soon as the ACCC lifts sale restrictions.

    This email is to advise those that aren’t yet aware that the Road Amendment (Approved Motor Bike Helmet) Rule 2015 came into force last Friday 11 December.

    This Rule amends Rule 270 of NSW’s Road Rules 2014 to allow motorcycle helmets that meet the global standard UNECE 22.05 to be legally worn in NSW.

    As you are aware, the ACCC recently revoked Consumer Protection Notice No 9, meaning that from Friday 27 November 2015 motorcycle helmets that met UNECE (ECE) 22.05 were allowed to be imported into and sold in Australia. Friday’s law change now makes those helmets legal on the road in NSW.

    The Rule amendment can be found on the NSW Legislation website .

    The Centre for Road Safety has updated its motorcycle helmets webpage to include reference to the new law, and is in the process of updating the relevant pages of the Ride to Live and CRASH websites.     Exciting news from the ACT MRA, as of yesterday the 22 December the ACT have ensured that helmets certified to ECE2205 are legal for use along with Cameras and Bluetooth communications devices on helmets. ECE22.05 was expected but allowing the use of cameras and comm's units and documenting it is a major win.

    Congratulations to Jen Woods and the team in the ACT and more specifically Guy Stanford and the AMC helmet committee, these are the people that have brought riders helmet reform.
    If you look carefully at Clause 5 in the ACT document it addresses the issues raised by Guy and Dr Bruce Campbell in their presentation at the Standards Australian helmet forum.

    So what happens when u are stopped in WA and SA from NSW with ECE aproved hement ? Wearing electronic attachments

    What Boof means is that ECE approved Helmets are not legal in WA and SA. So likely to get a ticket.

    They were not legal in NSW either until December 11 2015. So riding with ECE Helmet from Queensland to Victoria before that date, would have meant your lid would be illegal on NSW leg of trip. This is not the case anymore, but still is on a trip from NSW to SA/ WA;

    I am sure it wont be long before all States approve their use though

    At next Monday's MCC meeting, Mon 7th March, we will have Guy Stanford as our guest speaker.

    Guy will be addressing the audience on the ACCC, helmets, for sale and use laws and how they affect you.

    As you well know Guy is the expert on helmet law and ACCC laws so this will be well worth your time.


    Guest speaker next month, Monday the 4th of April will be an adventure traveller who has recently finished a trip from the UK to Australia on his BMW.

    Lots of info on border crossings and what to expect on a trip like this.

    If you are planning a trip or even thinking about one you should come along to this free session.



    Meetings are held at Ryde X Servicemens club.

    And that completes the set, except we’re still waiting for SA to Gazette the change to allow use of helmets certified to ECE 22-05.

    SA has indicated it intends to change the law by Gazette next month.

    European helmets have been legal to sell in all States and Territories since November 2015
